Why can't YouTube ban IP addresses from making copyright claims if the IP addresses keep abusing the powers?
Any idiot can use the user-friendly (ironic) interface YouTube has for submitting copyright complaints, but it takes someone with a bit more technical know-how and a lot more patience to circumvent an IP ban AND submit fake reports.
There needs to be more counter-measures against abuse. Banning troll accounts is pointless since troll accounts have no videos, no views, and no value to the user. Whereas the accounts banned due to trolls have all three of those things, and all three of those things take a VERY LONG TIME to accrue. I say ban the IP addresses from submitting claims, continuous abuse from a specific range should be range banned from using the copy claim service. The IP bans need not ban the IP from all of YouTube, but instead prevent the IP from submitting copyright claims. To counter any uproar, the bans could be appealed against and they can also expire if it's a first time offence.
This is coming from a guy who is using common sense and posting his thoughts for free. They pay fuckers lots of cash at Google HQ to fail at what I'm doing.
It's time the fandom emancipates itself from youtube. If it can easily be manipulated by those wastes of carbon and oxygen, it's best to move it elsewhere.

The only way to guarantee the wellbeing of fandom is a coordinated action which would try to make a compromise with Hasbor about their copyrights.
Artists need to work in peace, uploaders of various content need not to fear of being sued and people, who want to watch episodes need to do it without breaking any laws. It could be done but nobody cares. PonyArchive was abandoned instantly. Some of us were sending emails to Hasbro and MLP-related people about condition of fandom but we are not organized in any way. We have no brand like Equestria Daily which could be our representative.
I believe that we could make an agreement with Hasbro which would make everyone happy. They get unbelievable aid from us with promoting the show. It's even more unbelievable that they are not milking it much more. For example, there is no merchandise specially for bronies and "shrek-styled" merchandise which would hold references to our memes etc. while still being normal toys for children. Producers of the show are somewhat with us but they are contract workers of Hasbro after all.
I was going to buy shitloads of pony stuff as gifts for Christmas though there is almost nothing from G4 around here available, but it seems like Hasbro doesn't give a slightest funk about people like me not even allowing me to legally buy their show (making phony itunes accounts is not a legal way to buy it) or downloading it in a civilized manner. Looks like I'm buying barbies and other bullshit like that this year.
What's the situation now? We will get whatever we want anyway because things like torrents exist. Damn, we don't even need their merchandise as we make our own. Even sites like Equestria Daily can move to countries like Ukraine. Try to sue us there. I'd wish them luck anywhere outside Northern America. We even have our professional Season 1 DVD box while they are still working on it! Agreement between fandom or otherwise, trolls will still attack YouTube videos. Only if there was an agreement, Hasbro would be swamped with thousands of calls from the fandom's reps regarding takedowns and all of that bullshit. It'll stress Hasbro out, which'll end with the trolls winning because relations between Hasbro and the fandom would deteriorate.
The REAL ISSUE HERE is YouTube refuses to deal with what can be called cyber-terrorism. We should be angry at YouTube and their owners, Google, for failing to protect the rights of it's users and for failing to ensure that false claims were not as easy to submit as they are. Victims of fake takedown notices have NO DEFENSE against attacks, even if a channel or video gets reinstated, the damage has been done to the user's views, and their subscribers would have panicked.

@Maquabra I can't see there ever being an agreement between the community and Hasbro. I'm fairly certain the main reason Hasbro didn't bother taking anything down as long as they did was because the stuff online wasn't really competing with anything they had out. Now there's DVDs coming out, and the iTunes thing probly makes them money as well, so they're getting rid of the (illegal) competition.
As for being a community, I think we'd have rallied around Ponyarchive a bit more if they hadn't literally told Hasbro to fuck off. I'm not happy that Ponyarchive went away, but I wish they would've done so with some tact rather than biting the hand that feeds us and could bring the hammer on everything if we piss them off.
Moving on, this "we'll get what we want no matter what" attitude is a really bad idea. It's more likely to piss Hasbro off than encourage them to work with us, and will only make things worse. Look at the game industry. Pirates laugh in companies' faces, and the companies respond by putting out even harsher anti-piracy measures. Do you really want something similar to happen here?
Finally, I really do wish Google and YouTube would find a better way to deal with copyright issues, but I don't know what that way would be. It's not like they have the manpower to review every video that comes in, after all, or probly even every video that gets flagged.
I can't see how YouTube can maintain a system which is so open to abuse. Why do they not have some vetting system before they take down the videos and channels of legitimate users? It's ridiculous that they give more power to trolls than users.

Given what they're doing here, they're probably doing something more illegal elsewhere. If someone had the expertise, it would be better to expose them.
No such thing as "freedom of expression" in a private context such as YouTube. Never has been. The First Amendment in the US (which is all that matters here, YouTube is under American law) regulates only what the government can do. Since YouTube is not the government, and is a private entity with terms of service that say it can disallow anything it feels like, that's the way it is.
What YouTube CANNOT do is lie about a user or deliberately violate its own terms of service. Their ToS, in keeping with governing law (the DMCA) states that only the holder of the copyright may file a claim. Nobody except Hasbro Studios or the fan artists in a fan-based video has legal standing to take down a pony video based upon the visual content. Nobody but the record label, musician or the RIAA (which has been given power of attorney to do so by the labels) has legal standing to take down a video based upon the audio. If YouTube posts a message claiming you have violated copyright OR that the takedown was in compliance with their ToS (which is a contract), and you haven't/they haven't done due diligence/are recklessly believing everything they hear in a takedown claim without verification, they are engaging in libel.
Obviously, Google is not complying with this, and one of these days it's going to get them in trouble. Google is simply banking upon the conjecture that hiring people to review copyright claims before the videos are taken down is more expensive than the eventual fines and libel settlements, that nobody will take it to court, and that the judge will not place negative value on having your good name slandered. They certainly are not in compliance with either the DMCA or their own ToS, and that's a fact.

As for the trolls doing false claims, identifying them through the discovery process in court, then going to their house and beating them til they can't walk without a cane is the way to go. Trolls respond only to their own physical pain, so it's time they had some.

Partially off topical thing to suggest, but since Youtube is getting more and more unstable place to upload videos, I have couple of alternatives. (Oh by the way in case someone wonders, no I don't even get a chance to negotiate to get bigger upload time-limit on Youtube, because I've been tagged/flagged for few coperighted materials.)
Fair thing to note well before hand, that these solutions are is you already own a blogging-spot or website. I personally have started to upload less and less on youtube mainly because there are far too many restrictions for my future content (especiallly since I'm going to do a lot of archiving).
Just to note that the main pro of all these websites are that there's no time-limit and you can upload more content with commentries and such. And in case of video is about being taken down, most of the time the dev/web-admin will contact you first, at least this is something I heard of from other users feedback (unless of course the content was totally offensive/broke all the rules).

A buttload of channels have died this same way. Allow me to link a video I, along with about 5000 other Youtubers, mirrored on my own channel as a way to spread the video around, and hopefully get it noticed by the YouTube higher-ups.
From what I gather they're an anti Brony troll group, they're submitting alse claims to alot of pony related videos and youtube has to take them down as a reponse.
You can file a counter claim and get them out back up but as far as I know it takes some time.
It's probably not the actual Fox that asked for the takedown.

VastaKustutaArtists need to work in peace, uploaders of various content need not to fear of being sued and people, who want to watch episodes need to do it without breaking any laws. It could be done but nobody cares. PonyArchive was abandoned instantly. Some of us were sending emails to Hasbro and MLP-related people about condition of fandom but we are not organized in any way. We have no brand like Equestria Daily which could be our representative.
I believe that we could make an agreement with Hasbro which would make everyone happy. They get unbelievable aid from us with promoting the show. It's even more unbelievable that they are not milking it much more. For example, there is no merchandise specially for bronies and "shrek-styled" merchandise which would hold references to our memes etc. while still being normal toys for children. Producers of the show are somewhat with us but they are contract workers of Hasbro after all.
I was going to buy shitloads of pony stuff as gifts for Christmas though there is almost nothing from G4 around here available, but it seems like Hasbro doesn't give a slightest funk about people like me not even allowing me to legally buy their show (making phony itunes accounts is not a legal way to buy it) or downloading it in a civilized manner. Looks like I'm buying barbies and other bullshit like that this year.
What's the situation now? We will get whatever we want anyway because things like torrents exist. Damn, we don't even need their merchandise as we make our own. Even sites like Equestria Daily can move to countries like Ukraine. Try to sue us there. I'd wish them luck anywhere outside Northern America. We even have our professional Season 1 DVD box while they are still working on it!
With some kind of a deal, youtube content maybe could be protected too as it happens with other stuff that can be used for non-commercial use.
It's a ll possible but this fandom seems to be just a fandom, not a community. When PonyArchive was destroyed, the only real reaction was posting of a mocking picture. I bet that hearts of people behind PA grew thanks to all the support they got from people benefiting from their work...
Someone recognized in the fandom just needs to try to initiate dialogue with Hasbro. It's that simple.
If you see any videos you like download them. There are plenty of YT downloader add-ons for browsers for free. Re-upload them to YT again and paste the link in comments.

Only if there was an agreement, Hasbro would be swamped with thousands of calls from the fandom's reps regarding takedowns and all of that bullshit. It'll stress Hasbro out, which'll end with the trolls winning because relations between Hasbro and the fandom would deteriorate.
The REAL ISSUE HERE is YouTube refuses to deal with what can be called cyber-terrorism. We should be angry at YouTube and their owners, Google, for failing to protect the rights of it's users and for failing to ensure that false claims were not as easy to submit as they are. Victims of fake takedown notices have NO DEFENSE against attacks, even if a channel or video gets reinstated, the damage has been done to the user's views, and their subscribers would have panicked.

VastaKustutaI can't see there ever being an agreement between the community and Hasbro. I'm fairly certain the main reason Hasbro didn't bother taking anything down as long as they did was because the stuff online wasn't really competing with anything they had out. Now there's DVDs coming out, and the iTunes thing probly makes them money as well, so they're getting rid of the (illegal) competition.
As for being a community, I think we'd have rallied around Ponyarchive a bit more if they hadn't literally told Hasbro to fuck off. I'm not happy that Ponyarchive went away, but I wish they would've done so with some tact rather than biting the hand that feeds us and could bring the hammer on everything if we piss them off.
Moving on, this "we'll get what we want no matter what" attitude is a really bad idea. It's more likely to piss Hasbro off than encourage them to work with us, and will only make things worse. Look at the game industry. Pirates laugh in companies' faces, and the companies respond by putting out even harsher anti-piracy measures. Do you really want something similar to happen here?
Finally, I really do wish Google and YouTube would find a better way to deal with copyright issues, but I don't know what that way would be. It's not like they have the manpower to review every video that comes in, after all, or probly even every video that gets flagged.

VastaKustutaNo such thing as "freedom of expression" in a private context such as YouTube. Never has been. The First Amendment in the US (which is all that matters here, YouTube is under American law) regulates only what the government can do. Since YouTube is not the government, and is a private entity with terms of service that say it can disallow anything it feels like, that's the way it is.
What YouTube CANNOT do is lie about a user or deliberately violate its own terms of service. Their ToS, in keeping with governing law (the DMCA) states that only the holder of the copyright may file a claim. Nobody except Hasbro Studios or the fan artists in a fan-based video has legal standing to take down a pony video based upon the visual content. Nobody but the record label, musician or the RIAA (which has been given power of attorney to do so by the labels) has legal standing to take down a video based upon the audio. If YouTube posts a message claiming you have violated copyright OR that the takedown was in compliance with their ToS (which is a contract), and you haven't/they haven't done due diligence/are recklessly believing everything they hear in a takedown claim without verification, they are engaging in libel.
Obviously, Google is not complying with this, and one of these days it's going to get them in trouble. Google is simply banking upon the conjecture that hiring people to review copyright claims before the videos are taken down is more expensive than the eventual fines and libel settlements, that nobody will take it to court, and that the judge will not place negative value on having your good name slandered. They certainly are not in compliance with either the DMCA or their own ToS, and that's a fact.

As for the trolls doing false claims, identifying them through the discovery process in court, then going to their house and beating them til they can't walk without a cane is the way to go. Trolls respond only to their own physical pain, so it's time they had some.

(Oh by the way in case someone wonders, no I don't even get a chance to negotiate to get bigger upload time-limit on Youtube, because I've been tagged/flagged for few coperighted materials.)

I personally have started to upload less and less on youtube mainly because there are far too many restrictions for my future content (especiallly since I'm going to do a lot of archiving).
Just to note that the main pro of all these websites are that there's no time-limit and you can upload more content with commentries and such. And in case of video is about being taken down, most of the time the dev/web-admin will contact you first, at least this is something I heard of from other users feedback (unless of course the content was totally offensive/broke all the rules).

Volcano is owned by Sony, and all other record labels he has published under aren't owned by Fox. And Hasbro is a publicly traded company, which is in no way owned by Fox.
Conclusion: Youtube needs to shape up their Copyright verification process, requiring actual human contact from company legal departments before DROPPING THE FLUTTERING BANHAMMER ON FAN MADE CONTENT!
