I'm assuming the blatant mis-spelling of Hasbro sort of makes it a bit obvious. For those still unsure of the recent youtube pony bannings, it looks like this was the case all along.
That or Hasbro typo'd, but I doubt that's the case.

Unfortunately, there is very little that can be done at this point. It seems like a tremendous flaw in YouTube's intellectual property standards that just anyone can write in with a complaint and have any video taken down for infringement violations. Worse, once it happens, it's pretty much impossible to make it un-happen.

ReplyDeleteYou know, there's a think called the Digital Millennium Copyright Act that YouTube and/or Google has to worry about not violating. This is probably why YT is so draconian with handling copyright claims. Would you dilly-dally with checking the source of the flag and risk a swift lawsuit?
ReplyDeleteI hate seeing the damn copyright claim notice as much as anyone (if not more), but blame the DMCA and everyone that backed it for all of this crap.
While a copyright infringement claim must be submitted in writing in order to be legally enforceable, YouTube has an electronic submission form for copyright violation claims on its website. I assume that YouTube acts immediately on electronically submitted claims pending receipt of written notice from the claimant.
ReplyDeleteThat said, their grievance system for a counterclaim (as in the case of a spurious claim, which this appears to be) is RUBBISH. Either way, I imagine it is company policy to wait a set amount of time for the written claim to come in before acknowledging that the electronic claim was falsely submitted.
If a false WRITTEN claim is submitted, then the claimant can be prosecuted for perjury, but there seems to be precious little avenue for redress against spurious claims submitted electronically.
Boo-sucks.

One of the good things about having those YouTube videos is that you find comments that make you laugh your hooves off. They can provide as much humor, and food for thought as the episodes because us bronies can think up of unexpected, and interesting things to say. I'd hate to see that stuff deleted forever; I truly really do.

The recent false copyright claims of which you speak where the claimants couldn't even spell Hasbro, Inc. correctly only reinforce that fact. Hasbro would at least make sure to spell their own company's name correctly if they were going to flag all the pony videos, and they would definitely have admitted to copyrighting them on one of their sites. Hopefully MenloMarseilles and everypony else who had their FiM videos taken away and their channels deleted will have their videos reinstated very, very shortly, because this shit is getting VERY ridiculous here.

At the core, the show exists to advertise the toys, and toy sales have definitely been up for this franchise due to its internet presence. I notice a lot of people being angry at youtube over this, and yes, the system in place is easily exploited, but consider this:
ReplyDeleteThere are millions, if not billions of videos on Youtube, far more than its staff could hope to police and keep tabs on. If an actual company (IE: not trolls) comes to them and says "This video infringes on our copyright, take it down," they're really saying "Take this down right now or we'll sue your asses off." Youtube's staff simply doesn't have the time to investigate every claim made before taking down the videos, so instead they take a "guilty until proven innocent" stance. They take down the video immediately to avoid lawsuits and if the user who posted the video makes a case that the video should remain up, Youtube considers it and might put the video back up. But from a legal stand point it's much safer for Youtube to take down potentially infringing videos immediately than to investigate them thoroughly first.

ReplyDeleteHasbro literally did not file a claim to any MLP videos for, if you're assuming that Hasbro was actually responsible, six or seven months. If they wanted MLP out of the way, they would have done it much sooner. Especially when the pony craze was still in full swing. It's fairly evident that Hasbro was okay with the pony videos pervading the internet. Hasbro is a toy company. And as such, they don't benefit as much from capping episodes online. That's the long and short of it.
Aside from that, The Hub being a non-standard channel doesn't have much to do with anything. Because if you want to argue ratings on the actual TV show, they've never been higher. It's The Hub's big show, essentially. It's enjoyed the highest ratings and heaps of acclaim, according to fiscal reports from none other than Hasbro. In fact, they've been signing deals all over the world. It was actually a newspost here earlier.
On the topic of the fiscal report, I should also be inclined to mention that Hasbro also reported some extraordinarily high sales of the MLP franchise. MLP sales rose 30% in Canada when FiM aired, it's grown 30% overseas and has remained strong in the US. This all happens parallel to a massive outburst of internet-bourne MLP love. Hasbro is not full of idiots. They've spent twenty years appealing to the "nerd" demographic and know exactly how to do it and most importantly know it's there. To assume they don't know otherwise is stupid. They knew the benefits of these kinds of persistent internet communities and adapt strategies to accommodate them. Case in point, the fact that pony videos have been left untouched (as the auto-flagging has been all but confirmed as trolls).

This is Hasbro's sister company. They're responsible for "Small Horses that Are in My Possession." The shows are similar, but different enough not to invoke copy write notices.

For now, The HUB only appears to be a North American thing since bronies on other continents aren't able to get that channel and MLP is instead hosted on other channels.

ReplyDeleteI think you're misunderstanding the relationship between Hasbro and bronies. Hasbro is delighted that we love the show and interacts with this site and the fanbase quite a bit. They're perfectly aware that most of us watch the show via Youtube, and have never made a claim or complaint before. This recent spate of bannings is unusual behavior in many ways for the company. They like their fanbase, and would tell us before/shortly after taking action like this. They don't openly say that the show doesn't make as much money as the toys, but considering that the original purpose of the show is to sell the toys, it'd make sense that they'd want as many people to see it as possible. Also, don't underestimate a brony's love for the toys. I'll have nothing else on my Christmas list this year. ;)

The video is removed immediately upon upload. I've been using Mentos' .mkv files, and I believe that this just means that those particular files are flagged by YouTube now.
I am not going to go through the hassle of editing the movie to get around this, if that is the case, and yes, I tried renaming the file before reupping again (surprise, surprise, it didn't work). I'm done, and the videos aren't coming back.
May upload Season 2, if Mentos continues to provide the 1080p rips, but I can't redo Season 1, as you see above.

What Hasbro should do is just send a letter to Google saying "Look, just ignore any and all digital copyright claims for My Little Pony: Friendship is Magic on YouTube. ReplyDeleteThe guilty until proven innocent stance Twilight mentioned up above is pretty much a direct result of the DMCA. Not giving a site any temporary (until they can reasonably chekk for validity) protection if someone posts copyright infringement and the site is informed was a pretty big mistake when the law was written.
ReplyDeleteYoutube is still partly at fault here for the way will take down entire accounts on unreviewed claims (unless there really are so many accounts with repeated claimed infringement that they don't hav the staff for that.)
It's a really hard position for Youtube, but I think they would be able to do a somewhat more reasonable job of taking down based on claims if they had some way of screening infringement claims. Starting with chekking for a legitimate company name...

If I was the director of Hasbro I'd be EXTREMELY angry that someone impersonated my company and removed something that was giving it so much publicity for no cost. (Omitting the production of the show itself of course)

ReplyDeleteI'm a long time user of youtube and currently am cooljunkproductions on youtube and have encountered a DMCA copyright notice. That's what that is.
ReplyDeleteAnd the good thing is that you can dispute it, and with something as obviously fake as that, you will win the dispute.
And another thing: it really isn't Youtube's fault. Youtube's system is to prevent them from getting sued. There are soooo many copyrights out there, that youtube must allow anyone to file a copyright claim.
And Youtube must abide by the Digital Millennium act, so you really can't blame youtube! blame the haters!

ReplyDeleteNo, it's YouTube's fault for having such an easily exploitable system that they probably don't even monitor in the first place.
Now,I'm assuming it isn't Hasbro,but I wouldn't say it's 'fully confirmed'. There are humans working there and they're liable to have typos.

ReplyDeleteThe parasprites and neighsayers got PensivePony's videos taken down 12 hours ago as well... I've about had it with YouTube. I'm thoroughly convinced that YouTube's flagging system is automated... Even Derpy Hooves could do a better job at reviewing copyright claims than the people or machines in charge of YouTube are doing.
ReplyDeleteMeantime, if everypony feels as disillusioned with YouTube as I am beginning to feel, there are plenty of other video-sharing websites that don't cater to parasprites, neighsayers and false-flaggers. Seek them out. DailyMotion and Vimeo are two of those sites. There are plenty of others out there where you can upload pony videos without fear of having them falsely flagged.
