She just opened up pre-orders this morning for everything over on her website (Pony Orders) The best (and cheapest) way to get these pins is in bulk, which is the whole point of this system!
Pins will be $2 each, and shipping will depend on your location. It will take 3 weeks to a month to get the pins from the company once they have been ordered.
And a quote from Kanamai about the Rainbow Dash Pins:
"The Rainbow Dash pins that were ordered a couple weeks ago will be arriving in the mail either on the 18th or 19th. I will be shipping a large batch of pins on the 21st. So if you ordered one of these you should get a shipping notice this week. Pictures of the Rainbow Dash pins will be posted as soon as I get them."Anyway, the link to the pre-order page is below!

ReplyDeleteHasbro don't seem to care about the fan-made Transformer products which are actively competing against their core line, I'm sure they won't mind some pony pins, especially since they don't actually make them themselves so there is no profit loss for Hasbro.
ReplyDeletePeople make Pokemon Badge pins all the time and such. Creating fan works fall under parody, which is legal.
ReplyDeleteI'm pretty sure this wouldn't be considered parody as it isn't a parody. Almost all of them are direct rips of the legit cutie marks. Hasbro would probably have every right to sue, but most companies generally turn a blind eye toward fanworks so I wouldn't worry.

ReplyDeleteOh, parody is perfectly legal, even when you are getting paid for it. However, parody has to change something (becomes a transformative work). This simply doesn't.

This is non-malicious, non-plagiarism (not claiming as one's own work), and not a breach of any law.
You are paying for the raw materials and the production of the item, not for the intellectual property.

And Hasbro is yet to shut down anything related to the fandom, it appears that they don't mind the fans making things and selling on to other fans - especially since its non-profit.

I have exactly the same right to go out and buy shrinky dink paper and print cutie marks on them, turn those into little bracelets, and sell them to my friends for the base cost of the shrinky dink paper.
Hasbro can not and will not sue over this.

ReplyDeleteAs for Hasbro and the cutie mark pins, if Hasbro were to make these cutie mark pins I would buy them! I mean, they would have to be seriously shitty pins for me not to buy them. I guess that if Hasbro was to make pins, they would probably end up being clip-on pins to avoid little girls accidentally poking themselves with them and dying of tetanos.

It wont be anywhere near $20 unless you live in Europe and do priority mail shipping or something. Or order an ungodly amount of pins.
You should do singles of the Gems/apples/butterflies, so that way if you buy 3 and you put them together you would have a pretty accurate representation of the cutie mark.

ReplyDeleteThe way I see it, they secretly recognize that they can't make merchandise to save the world, and so they just leave an empty slate for godly things like tis.
Hasbro *could* throw a fuss over this, but hopefully won't. They usually seem pretty laidback.
ReplyDeleteNow, if it were Marvel, they'd be sending cease-and-desist letters all over the place. I remember them shutting down sites that were offering free Spider-Man skins for "The Sims".
It is true that this is on the border of being legal/illegal, but Hasbro has yet to shut anything down relating to MLP. Considering the amazing growth of the show more recently, I see this as a smart business move. As LadyM said, Marvel is one of the companies that would shut us down. Viacom is another, with their recent shutdown of a ton of spongebob YTP's. But Hasbro has been fine with this, and I am sure they will be for a long time.

I do hope you will continue to update the status of the pin orders here and on Ponychan. (I received the Mailing List invite but my ISP is probably junking my mail from Listserv's so I did not join.) I expect that billing for each pin design will wait until that design reaches 300 preorders?

I ordered more than 500 pins to push the cost of the main 6 characters to $2 each for everyone. I'm sorry I couldn't do it for all the pin designs.
